End User License Agreement (EULA) for Gravity Gunslinger

This End User License Agreement ("EULA") is a legal agreement between you and Byte Machina - Stefan Adrean Huber ("Licensor," "we," "us," or "our") for the software application Gravity Gunslinger ("the Game").

By downloading, installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the Game.

1. LICENSE GRANT

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Game strictly for your personal, non-commercial purposes in accordance with the terms of this EULA.

2. LICENSE RESTRICTIONS

You agree not to, and you will not permit others to:

a) Copy, modify, decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the Game.
b) Sell, rent, lease, sublicense, distribute, or otherwise transfer the Game to any third party.
c) Use the Game for any commercial purpose.
d) Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software designed to modify or interfere with the Game experience.

3. OWNERSHIP AND INTELLECTUAL PROPERTY

We retain all right, title, and interest in and to the Game, including all copyrights, trademarks, and other intellectual property rights. This EULA does not grant you any ownership rights in the Game.

4. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY (IMPORTANT EPIC GAMES CLAUSE)

THE GAME IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, WE, ON OUR OWN BEHALF AND ON BEHALF OF OUR AFFILIATES, EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE GAME.

THE GAME USES UNREAL® ENGINE. EPIC GAMES, INC. AND ITS AFFILIATES PROVIDE NO WARRANTIES WITH RESPECT TO UNREAL® ENGINE AND EXPRESSLY DISCLAIM ANY AND ALL LIABILITIES, OBLIGATIONS, OR REPRESENTATIONS RELATED TO THE GAME.

IN NO EVENT SHALL LICENSOR OR EPIC GAMES, INC. BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF OR INABILITY TO USE THE GAME.

5. TERMINATION

This EULA is effective until terminated. Your rights under this license will terminate automatically without notice from us if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the Game and destroy all copies of the Game in your possession.

6. GOVERNING LAW

This EULA shall be governed by and construed in accordance with the laws of [Germany], without regard to its conflict of law provisions.
